Open source software has been the backbone of startup innovation for thirty years. It lowers the cost of building, speeds up shipping, and gives small teams access to infrastructure that would take giants years to construct. But a new AI capability is quietly threatening the foundational assumptions that made that model work — and most founders have not noticed yet.
A tool called Malus.sh just made the threat visible. It offers to clone any open source software project using AI — stripping the original copyright license in the process — for less than a cent per kilobyte of code. The result is a functionally identical piece of software that, under certain legal interpretations, owes nothing to the original developers. No attribution. No copyleft obligations. No open source license requirements at all.
The site is satire. It is also real, profitable, and technically functional.
That combination should get every startup founder’s attention.
What Malus.sh Actually Does — And Why It’s Not Just a Joke
Malus.sh was created by Dylan Ayrey and Mike Nolan, who presented the concept at FOSDEM 2026, the flagship open source developer conference. Nolan, who researches the political economy of open source software and works for the United Nations, built Malus as a provocation — a piece of functional satire designed to force a conversation that he says the open source community keeps avoiding.
The tool works by running two AI agents in sequence. The first agent examines the target software and writes a technical specification — what the software does, how it behaves, what outputs it produces. A second, completely separate agent then writes new code from scratch using only that specification, never touching the original source. This two-stage process is called a “clean room” design.
The concept has real legal precedent. In 1982, a company called Columbia Data Products needed to build IBM-compatible computers without copying IBM’s BIOS code. Their lawyers devised the clean room method: one team documented what the BIOS did, a separate “clean” team wrote a new BIOS that met those specifications without ever seeing the original. Courts validated this approach, and it became a foundational legal strategy in software development. It powered the creation of compatible computing ecosystems and made personal computing far more competitive.
What Malus.sh has done is collapse the cost and time required to execute a clean room clone from months of expensive engineering work to a matter of minutes for less than a dollar.
“What used to require months of work by expensive engineering teams can now be done trivially,” wrote Dan Blanchard, a software engineer who found himself at the center of a controversy when he used Claude to rewrite chardet — a widely used Python library — switching it from a restrictive LGPL license to a more permissive MIT license. The original chardet author, Mark Pilgrim, objected strenuously. Legal status: still grey. Technical reality: the rewrite existed, it worked, and the process was cheap.
The Economics Have Flipped. Most Startups Haven’t Caught Up.
Before AI, the clean room strategy was primarily a tool for large companies with serious legal budgets. It required coordinated teams, long timelines, and significant capital. That economic reality was the true barrier against casual exploitation of open source software — not the licenses themselves.
Blanchard put it directly: “The reality of the situation is that traditional software licenses — open source and commercial — weren’t the real barrier against these sorts of rewrites in the past. The main obstacles were time and money.”
AI has removed both barriers.

First: Any software component that your startup has built on top of open source libraries — or that is a thin layer on top of open source infrastructure — is now potentially replicable by a well-resourced competitor in a day. Mike McQuaid, developer of Homebrew, the massively popular open source package manager, summarized it plainly when asked about AI clean room cloning: a replica of open source software at a point in time captures none of the ongoing value that open source projects actually deliver.
“Open source isn’t just source code you download once,” McQuaid noted. “It’s an ongoing relationship: security patches, bug fixes, adaptation to new platforms, accumulated expertise from years of triage and review. A clean room reimplementation gets you a snapshot with none of the maintenance. Nobody is watching for CVEs, and nobody knows what to do when it breaks. That’s not liberation — it’s technical debt.”
For startup founders, this cuts both ways.
If you are thinking about using AI cloning to shed a restrictive license on a library you depend on, what you actually get is a snapshot of that library’s functionality — frozen in time, without the upstream security updates, bug fixes, and compatibility improvements that the open source community continues to ship. You are trading legal flexibility for engineering debt.
And if a competitor uses AI to clone your product or the open source layer you have built your differentiation on top of, the cloned version will have the same problem. It will work — but it will not have your accumulated operational knowledge, your support infrastructure, your customer success insights, or your roadmap. The code is not the moat. The practice is the moat.

The Legal Grey Zone Founders Need to Understand
Meredith Rose, senior policy counsel at Public Knowledge who focuses on copyright and IP reform, offered the most important legal framing of the Malus.sh situation: “Clean rooms worked because courts kind of looked at the whole clean room methodology and were like, there’s a lot of labor that goes into this. That’s part of the calculus. The idea of collapsing that into something where you can press a button and get an entire package recreated is kind of wild — even though it is technically correct under the law as far as I can tell.”
Two words that should make every founder pause: “as far as I can tell.”
The law has not caught up. Courts have not yet ruled on whether AI-generated clean room clones are genuinely original works — especially given that the large language models used to produce the clone were trained on the very code they are being asked to replicate. The AI that writes your clean room version of a GPL library almost certainly ingested that library during training. Whether its output is genuinely independent or is inherently derivative is a question that lawyers are actively arguing and courts have not yet settled.
This is not theoretical risk for startups. It is the kind of ambiguity that delays enterprise deals, complicates due diligence, and can appear as a representation and warranty issue in investor term sheets.

None of this means that open source is dead or that AI cloning is a crisis without solutions. But it does mean that the IP strategy most early-stage startups run — “we built on top of open source and added proprietary features” — is no longer inherently defensible. You need to be deliberate about where your actual moat lives.

The Real Warning in Malus.sh
The creators of Malus.sh built a satirical LLC that charges a penny per kilobyte to prove a point. Their point is not really about copyright law. It is about the open source community’s collective blind spot: a tendency to assume that because your software is used everywhere, your position is secure.
Mike Nolan, who spent a decade researching how open source communities sustain themselves, put the underlying argument bluntly: “80 or 90 percent of all software applications rely upon open source, but what they’re relying upon is the wholesale exploitation of massive communities of workers who convince themselves that they’re winning because Google uses them.”
For startup founders building on top of open source, the same logic applies one layer up. You may be in the supply chain of something very large. That is not the same thing as having a defensible position.
