Legal AI adoption in federal courts is present but shallow — and the gap between the headline and the reality carries significant implications for every stakeholder in the legal SaaS ecosystem. A landmark survey published in April 2026 by Northwestern University researchers in the Sedona Conference Journal provides the most methodologically rigorous picture yet of how federal judges are actually using AI tools. The findings should recalibrate how PE investors value legal AI platforms, how founders position their products, and how enterprise CTOs set governance expectations.

The mainstream coverage will focus on the optimistic number: more than 60% of responding federal judges report using at least one AI tool in their work. That is a genuine milestone. Two years ago, the answer would have been closer to zero. But the number that matters for anyone making investment or product decisions is a different one: only 22.4% of judges use AI tools weekly or daily. The rest are occasional, experimental, or entirely absent users. In market terms, this is the difference between a tool that has crossed the awareness threshold and one that has become operationally embedded.

The Gap Between ‘Has Used’ and ‘Uses Regularly’

A judge who tries Westlaw’s AI-assisted research feature once a month is not a reliable revenue driver for Thomson Reuters’ AI product line. A judge whose law clerks use it daily to synthesize voluminous case records is. The Sedona study finds the second group is much smaller than the first.

The survey, conducted by researchers at Northwestern University and published in conjunction with the NYC Bar Association Presidential Task Force on AI and Digital Technologies, surveyed a stratified random sample of 502 federal Bankruptcy, Magistrate, District Court, and Court of Appeals judges. With 112 responses (22.3% response rate), it represents the most rigorous data point available on AI in the federal judiciary.

The adoption pattern follows a familiar enterprise AI curve: broad awareness, narrow operational integration. This is precisely the pattern documented across the broader enterprise market. The Tool Preference Is an Investment Signal

The specific tools judges use — and don’t use — are the most commercially actionable data in the survey. Two tools dominate: Westlaw AI-Assisted or Deep Research at 38.4% adoption, and ChatGPT at 28.6%. Everything else trails significantly. The pattern is not random.

Westlaw dominates because judges already trust Thomson Reuters. The AI features are integrated into a platform with decades of verified citation databases. The adoption path for Westlaw AI was not ‘convince a judge to try an AI tool.’ It was ‘surface AI features inside a tool judges already use daily.’ That is a fundamentally different sales motion than cold-selling a standalone AI product.

ChatGPT’s presence at 28.6% reflects personal use bleeding into professional experimentation — the survey confirms a statistically significant correlation between personal and professional AI use. But crucially, ChatGPT usage among judges is heavily weighted toward rare and monthly frequency. Only 4.5% of judges use ChatGPT weekly, and 0% use it daily. For OpenAI, the judicial market is an awareness story, not a revenue story.

Harvey and Legora Are at 0% — What That Means for Legal AI Valuations

The number that will sting the most in Silicon Valley is this: Harvey and Legora — two of the most heavily funded legal AI startups of the past two years — report exactly 0% adoption among responding federal judges. Not 1%. Not a rounding error. Zero respondents reported using either tool.

Harvey has raised over $300 million at a reported valuation exceeding $1.5 billion. Legora has raised substantial capital targeting the European legal market. Both have built their narratives around disrupting legal research and document review. The Sedona data suggests they have not yet crossed the institutional adoption threshold in the most scrutinized legal environment in the United States.

This does not mean these companies are failing. Large law firms are a different market than federal judges. But it does mean that any investment thesis built on legal AI penetrating institutional legal systems at pace needs to account for the structural barriers this data reveals: hallucination risk, policy vacuums, platform trust dynamics, and a judiciary that is governing AI adoption judge by judge rather than system-wide.

The Policy Vacuum — Governance Crisis or Market Opportunity?

Perhaps the most commercially significant finding in the Sedona study is the state of AI governance in federal chambers. The survey finds a dramatic absence of institutional policy: 24.1% of judges have no official AI policy at all, and 17.6% discourage AI use without formally prohibiting it. Combined, 41.7% of federal judges are operating without a codified framework for how AI may be used in their chambers.

That number is not a governance failure narrative. For SaaS companies selling AI governance, compliance, and verification tools into legal markets, it is a buying signal. Organizations in a governance vacuum are the most motivated buyers of products that create structure around AI workflows. The absence of policy creates the demand for policy infrastructure.

The policy fragmentation also reveals something important about the sales cycle for legal AI. One in three judges who formally prohibit AI use still carve out exceptions — particularly for Westlaw and Lexis integrations. This means the formal/prohibited label does not map cleanly onto revenue opportunity. Judges who say they prohibit AI often permit it within trusted platform guardrails. The practical adoption gate is not policy — it is trust architecture.

The winners in legal AI will be platforms that solve the policy problem and the hallucination problem simultaneously.

The Hallucination Factor — Why Judges Won’t Trust General AI

The qualitative responses in the Sedona survey are as revealing as the statistics. Multiple judges describe refusing to use AI because of documented hallucination incidents. One judge described a law clerk who used an unspecified AI platform to write a memo — and found that 10 of the 11 cases AI cited were fabricated. Another described hallucinated citations as ‘terrifying.’ A third said that if AI hallucinated citations appeared in one of their published opinions, they would have to consider resigning.

This is not technophobia. It is rational calibration based on documented evidence of AI failures. The hallucination rates Stanford researchers observed on complex legal queries — 69% to 88% — are exactly the failure rates judges are encountering in chambers. The gap between vendor benchmark claims (sub-1%) and production reality is the core adoption barrier in this market.

The judges who are actively adopting AI — the 22.4% using it weekly or daily — have solved this problem with process: independent verification requirements, restriction to trusted platforms with proprietary citation databases, and treating AI as a starting point rather than an authority. Their “trust but verify” framework is not a workaround. The data also reveals a generational dynamic that will reshape legal AI adoption over the next decade. Judges’ personal AI use is statistically correlated with professional AI use — the Chi-Square test in the Sedona study produces a p-value of 4.30 × 10⁻⁶. As younger professionals who grew up with AI tools become judges and senior partners, the adoption floor will rise organically. But the monetization window at current adoption levels is narrower than legal AI valuations assume.

What This Means: Three Audience Implications

Policy vacuum creates governance tooling opportunity. The 41.7% of judges with no official policy represents latent demand for AI governance infrastructure — a category with better near-term monetization potential than pure legal research AI.
FOR SAAS FOUNDERS TARGETING LEGAL MARKETS
The product-market fit signal is unambiguous: judges want AI embedded in trusted research platforms, not standalone chatbots. If you are not partnered with Westlaw, Lexis, or a credible legal data provider, your distribution path requires overcoming a substantial institutional trust deficit.
The use case that commands the highest adoption (30% of judges, 39.8% of chambers) is legal research. Document review is second at 15.5%. Draft and edit functions hover below 10%. Build and position around research and review — not drafting automation.
Hallucination-proof architecture is not a feature. It is the minimum viable product for institutional legal AI. Your go-to-market message must lead with verification reliability, not AI capability.
The judge who said “citing hallucinated cases or nonexistent law is a terminable offense” is your persona. Build for them, not for the legal tech enthusiast. The conservative, verification-first user is the one who drives institutional adoption.

FOR ENTERPRISE CTOs AND CPOs
The judiciary’s governance posture is the correct model for any high-stakes enterprise AI deployment. Verification requirements, platform restrictions, and human-in-the-loop mandates are not bureaucratic friction — they are the architecture that enables sustainable AI adoption.
The correlation between personal and professional AI use (p = 4.30 × 10⁻⁶) has direct implications for enterprise adoption strategy. AI fluency programs that raise personal comfort with AI tools will organically increase professional adoption rates.
The “trust but verify” framework judges describe maps onto enterprise AI governance. AI output that is independent-verified before use in consequential decisions is not a temporary workaround — it is permanent operating procedure.
Vendor platform selection matters more than AI capability claims. Judges who adopt AI successfully consistently do so through tools embedded in platforms they already trust. Enterprise AI strategy should prioritize integration with established systems of record over point solution evaluation.
The policy vacuum finding has a direct enterprise analog: organizations without a codified AI use policy are running the same institutional risk as the 41.7% of judges with no official framework. Policy documentation is a pre-condition for defensible AI deployment.

The Sedona Conference study is the most rigorous data point available on AI adoption in a high-stakes institutional context. Its findings do not tell a story of AI revolution in the courts.
